Welcome to Make My Houzz (“Make My Houzz”, “we”, “us”, or “our”). These Terms & Conditions govern your access to and use of our website, mobile applications, digital services, property listings, enquiry services, property assistance, loan assistance and other related services.

By accessing or using Make My Houzz, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

1. ABOUT MAKE MY HOUZZ

Make My Houzz is a real-estate technology and services platform designed to connect property buyers, sellers, owners, tenants, landlords, builders, developers, agents, agencies and other real-estate service providers.

Our services may include:

• Buying property
• Selling property
• Renting and leasing
• Residential and commercial properties
• Plots and land
• Builder and developer projects
• Sponsored/featured projects
• Property listing and advertising
• Agent and agency services
• Property loan assistance
• Property verification coordination
• Legal-document verification coordination
• Professional property valuation coordination
• Site-visit coordination
• Buyer and seller assistance

Unless specifically stated otherwise in writing, Make My Houzz acts as a platform/service facilitator and does not itself own properties listed by third parties.

2. ELIGIBILITY

Users must be legally capable of entering into a binding contract under applicable Indian law.

By using the platform, you confirm that the information submitted by you is accurate and that you are legally entitled or authorised to undertake the relevant property transaction or enquiry.

3. USER REGISTRATION

Certain services may require registration.

Users may be required to provide information including:

• Name
• Mobile number
• Email address
• Address
• Property details
• Identity information
• Ownership information
• Financial information where necessary for loan-related services
• Other information reasonably required to provide the requested service

Users are responsible for maintaining the confidentiality and security of their account credentials and for activities carried out through their accounts.

4. PROPERTY LISTINGS

Property owners, builders, developers, agents and agencies submitting listings must provide accurate and lawful information.

The person submitting a property represents that they have the necessary ownership, authority, mandate or permission to advertise or facilitate the property.

Listings must not contain:

• False ownership claims
• Misleading prices
• Fraudulent photographs
• Incorrect locations
• Fabricated approvals
• Misleading property specifications
• Duplicate or intentionally deceptive listings
• Properties prohibited from being sold, leased or advertised

Make My Houzz may review, modify, suspend or remove listings that violate platform policies or applicable law.

5. PROPERTY INFORMATION

Property information may be supplied by owners, builders, developers, agents, agencies and other third parties.

While reasonable efforts may be made to improve listing quality, Make My Houzz does not guarantee that every third-party statement regarding price, measurements, boundaries, title, approvals, amenities, availability, possession date, construction quality or other property particulars is complete or error-free.

Users should independently verify material information before entering into a transaction.

6. PROPERTY VERIFICATION

Where a property is identified as “Verified” or similar, the designation only represents the verification checks specifically undertaken under the applicable Make My Houzz verification process.

It must not automatically be interpreted as:

• A guarantee of legal title
• A government certification
• A guarantee against litigation
• A guarantee of construction quality
• A guarantee of future property value
• A guarantee that every document is authentic
• A guarantee that the transaction is risk-free

Users should obtain independent professional legal and technical advice before purchasing or investing in property.

7. LEGAL DOCUMENT VERIFICATION

Make My Houzz may facilitate access to independent advocates, legal professionals or verification providers.

Legal verification may include, depending upon the service selected, examination of documents such as title deeds, sale deeds, encumbrance information, approvals, tax records and other relevant records.

Unless expressly stated otherwise, the legal professional providing the opinion remains independently responsible for their professional advice.

Users should read the final legal opinion and resolve identified issues before proceeding with a transaction.

8. PROPERTY VALUATION

Make My Houzz may facilitate professional valuation services.

Any valuation represents an estimate based on available information, market conditions and the methodology of the relevant valuation professional.

Property prices may change and no valuation constitutes a guarantee of the property’s future sale price, rental income or investment return.

9. SITE VISITS

Make My Houzz may facilitate property visits between interested users and property owners, builders, agents or representatives.

Users should independently confirm property details during the visit.

Personal belongings, travel arrangements and individual safety during visits remain the responsibility of the respective users, subject to applicable law.

10. BUYERS

Buyers should independently verify before making a purchase:

• Ownership and title
• Property documents
• Applicable approvals
• Encumbrances
• Litigation, if any
• RERA details where applicable
• Property measurements
• Physical condition
• Taxes and statutory dues
• Possession status
• Sale consideration
• Registration requirements
• Loan eligibility

No payment should be made solely on the basis of an online listing without appropriate verification.

11. SELLERS AND PROPERTY OWNERS

A seller or owner listing a property confirms that:

1. They own the property or are duly authorised to represent the owner.
2. Information supplied is accurate to their knowledge.
3. Material legal disputes or restrictions will not intentionally be concealed.
4. Photographs and documents uploaded may lawfully be used for the listing.
5. Applicable taxes, approvals and statutory obligations remain their responsibility.

12. AGENTS AND AGENCIES

Agents and agencies using Make My Houzz must comply with applicable laws and registration requirements, including applicable RERA requirements.

Agents are independently responsible for their representations, services, commissions and conduct unless expressly acting as an authorised representative of Make My Houzz under a written agreement.

13. BUILDERS AND DEVELOPERS

Builders and developers are responsible for ensuring that project information, approvals, possession schedules, specifications and statutory disclosures supplied to Make My Houzz are accurate.

Projects required to be registered under the Real Estate (Regulation and Development) Act, 2016 and applicable state rules should carry the appropriate registration details.

14. SPONSORED AND FEATURED PROJECTS

Certain properties or projects may receive paid promotional placement.

A “Sponsored”, “Featured”, “Premium” or similar designation means the relevant party may have paid for additional visibility.

Such placement does not itself constitute a recommendation, legal verification, investment recommendation or guarantee by Make My Houzz.

15. PROPERTY LOAN ASSISTANCE

Make My Houzz may facilitate connections with banks, housing finance companies or other authorised financial institutions.

Make My Houzz does not guarantee:

• Loan approval
• Loan amount
• Interest rate
• Processing time
• Eligibility
• Disbursement
• Particular loan terms

Final lending decisions are made solely by the relevant lender based on its policies, credit assessment and applicable law.

16. FEES AND SERVICE CHARGES

Certain Make My Houzz services may be free while others may involve:

• Listing fees
• Featured-listing fees
• Subscription charges
• Service charges
• Brokerage/commission where applicable
• Verification fees
• Valuation charges
• Documentation or professional-service charges

Applicable charges should be communicated before the corresponding paid service is purchased.

Government duties, registration fees, taxes and third-party professional charges may be additional unless expressly included.

17. PAYMENTS

Payments made through the platform may be processed through authorised third-party payment providers.

Users must provide accurate payment information.

Refund eligibility, where applicable, will be governed by the refund/cancellation terms communicated for the relevant service.

Property consideration or deposits paid directly between buyers, sellers, builders, landlords, tenants or other third parties remain subject to the agreements between those parties.

18. RERA COMPLIANCE

Where applicable, property promoters, projects and real-estate agents must comply with the Real Estate (Regulation and Development) Act, 2016, relevant rules and the requirements of the applicable State/Union Territory Real Estate Regulatory Authority.

Users should independently check applicable RERA registration information before entering into a transaction.

19. USER COMMUNICATION

By submitting an enquiry or requesting a service, users authorise Make My Houzz and relevant service partners to contact them regarding that enquiry or service through permitted channels, subject to applicable consent and communications laws.

Marketing communications will be handled in accordance with applicable law and user preferences.

20. PROHIBITED USE

Users must not use Make My Houzz to:

• Commit fraud
• Impersonate another person
• Upload forged documents
• Advertise property without authority
• Misrepresent property information
• Violate intellectual-property rights
• Introduce malicious software
• Attempt unauthorised access
• Harvest user information unlawfully
• Conduct unlawful financial transactions
• Circumvent platform security
• Engage in activities prohibited under Indian law

Accounts or listings involved in suspected misuse may be restricted or suspended.

21. INTELLECTUAL PROPERTY

The Make My Houzz name, branding, website design, software, databases, text, graphics and proprietary platform materials are protected by applicable intellectual-property laws.

Users may not reproduce, commercially exploit, scrape, republish or distribute proprietary platform material without permission, except as permitted by law.

Users submitting property photographs, descriptions and other content confirm that they possess the necessary rights and grant Make My Houzz the rights reasonably required to display and promote the listing.

22. THIRD-PARTY SERVICES

Make My Houzz may connect users with:

• Property owners
• Builders
• Developers
• Agents
• Advocates
• Valuers
• Banks and financial institutions
• Loan service providers
• Other professional service providers

Unless expressly stated otherwise, such parties operate independently. Their services may be governed by separate terms.

23. NO INVESTMENT GUARANTEE

Property-related information available through Make My Houzz is provided for property discovery and service facilitation.

Make My Houzz does not guarantee:

• Property appreciation
• Rental returns
• Investment returns
• Resale value
• Future market demand
• Project completion except where legally attributable to Make My Houzz

Users should make investment decisions after conducting appropriate independent due diligence and obtaining professional advice where required.

24. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Make My Houzz will not be responsible for losses arising solely from unauthorised or inaccurate third-party representations, independent transactions between users, or decisions made without appropriate due diligence.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable Indian law.

25. PRIVACY AND DATA PROTECTION

Personal information will be processed in accordance with our Privacy Policy and applicable Indian data-protection law.

Where information is shared with banks, advocates, valuers, agents or other service providers to fulfil a user-requested service, such sharing will be subject to applicable consent and legal requirements.

26. ACCOUNT SUSPENSION OR TERMINATION

Make My Houzz may restrict, suspend or terminate access where reasonably necessary because of:

• Fraud or suspected fraud
• False information
• Unauthorised listings
• Illegal activity
• Security risks
• Material violation of these Terms

Where appropriate and legally required, users will be provided applicable notice or remedies.

27. CHANGES TO SERVICES AND TERMS

Make My Houzz may update its services and these Terms from time to time.

Material changes will be communicated or displayed as required by applicable law. Continued use following the effective date of updated Terms constitutes acceptance where legally permissible.

28. GOVERNING LAW

These Terms are governed by the laws of India.

Subject to applicable consumer-protection laws and other mandatory jurisdictional requirements, disputes shall be subject to the jurisdiction specified by Make My Houzz in its registered business and legal documentation.

29. GRIEVANCE REDRESSAL

For complaints relating to the platform, listings, transactions, privacy or services, users may contact the designated Grievance Officer.
